Welcome to the website of NetGame Entertainment N.V. (“NetGame”, “we”, “us”, “our”). These Terms and Conditions (“Terms”) apply to your access to and use of this website and any related services made available through it (the “Website”).

NetGame is a business-to-business (B2B) supplier of gaming platform software and game content, licensed by the Curaçao Gaming Authority (CGA) under supplier licence number OGL/2024/2331/1197 and having its registered address at Chuchubiweg 17, Curaçao. We supply our games and technology exclusively to licensed game resellers and online gaming operators (“our Clients”). As a B2B company, we don't have a player-facing service, and we don't accept wagers or hold any direct relationship with end players. If you are a player and have a question about an account, a deposit, or a game you played, please contact the operator of the casino where you played directly - they hold all the information needed to help you.

Your continued visits to the Website and/or use of the Service constitutes acceptance of these Terms and Conditions. We reserve the right, at our discretion, to make changes to these Terms and Conditions at any time. These changes may be required for a number of reasons, including but not limited to, for commercial reasons or in order to comply with new laws and regulations. You will be deemed to have accepted the changes to these Terms and Conditions by continuing to visit the Website and/or use the Service. If at any time you disagree to any portion of the then-current version of our Terms and Conditions, these Terms and Conditions shall immediately terminate, and you must immediately stop visiting the Website and/or using the Service.

By visiting the Website and/or using the Service, you agree to the following:

A. Visiting the Website

  • You must be at least 18 years of age, or the age of legal majority in your jurisdiction if higher, to access or use the Website.

  • You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Website by, any third party.

  • You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website.

  • You must not use any robot, spider, scraper, or other automated means to access the Website for any purpose without our express written permission.

  • By using our Website you consent to our Privacy Policy and, where applicable, our Cookie Policy.

B. Intellectual Property

The content of the Website, including but not limited to text, graphics, logos, game titles, artwork, and software (the “Intellectual Property”), is owned by or licensed to NetGame and is protected by copyright, trademark, and other intellectual property laws.

The Intellectual Property may not be used or interfered with in any manner without the express written consent of NetGame. Except as otherwise expressly authorised by these Terms and Conditions, you may not copy, reproduce, modify, amend, lease, loan, sell and/or create derivative works from, upload, transmit, and/or distribute the Intellectual Property in any way without NetGame's prior written permission.

Except as expressly provided herein, NetGame does not grant to you any express or implied rights to the Intellectual Property found on the Website. Except to the extent required by law or as expressly provided herein, none of the Intellectual Property found on the Website may be reverse engineered, modified, amended, reproduced, republished, translated into any language or computer language, re-transmitted in any form or by any means, offered for sale, sold or redistributed without our prior written consent.

NetGame only supplies its games and technology to our Clients that hold a valid gaming licence recognised by NetGame. If you come across a website offering NetGame-branded games and you are unsure whether it is operated by a duly licensed operator, we recommend that you do not trust your money to that site. Genuine NetGame games are only ever offered through reputable, licensed operators who display their licence and contact details. Counterfeit or “cloned” versions of our games may not offer the same probability of winning or return to player as a genuine version, and in some cases such sites might not pay out winnings at all.

C. Violations of These Terms

NetGame reserves the right to take action against any user of the Website who violates these Terms, including restricting or prohibiting any user from using the Website in whole or in part.

Should you wish to report any content that you think may violate these Terms, please contact us at the email address provided in Section F below.

D. Blocked and Restricted Territories

NetGame is subject to various regulatory and licensing requirements in relation to the territories in which its games and technology may be deployed by our Clients. As a result, the following applies:

  • NetGame does not permit its Operator clients to offer NetGame games or platform technology to players located in a territory where the relevant Operator does not hold an applicable gaming licence - whether a local licence specific to that territory, or an international licence recognised as entitling the Operator to offer remote gaming into that territory.

  • NetGame maintains an internal list of territories where deployment of its technology is restricted or prohibited, having regard to its own CGA licence conditions and applicable sanctions requirements. This list is provided to our Clients as part of their technical integration and is reviewed periodically.

  • If you have a question about whether a particular operator is entitled to offer NetGame games in your country, please contact that operator directly and ask them what licences they hold and what entitles them to offer games to your country - NetGame is not able to confirm an individual operator's licensing position to a website visitor.

E. Disclaimer of Warranties and Limitation of Liability

The Website and its content are provided on an “as is” and “as available” basis, without warranties of any kind, to the maximum extent permitted by applicable law. We do not warrant that the Website will be uninterrupted, timely, secure, or error-free.

To the maximum extent permitted by applicable law, NetGame shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your access to, or use of, or inability to access or use, the Website. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so.

As a B2B technology supplier, NetGame has no direct relationship with players and bears no responsibility for the conduct, licensing status, player-facing terms, customer support, or commercial practices of any Operator. Any issue relating to your play at an online casino, including deposits, withdrawals, bonuses, or account access, should be directed to that casino's own customer support team.

F. Contact and Governing Law

These Terms are governed by the laws of Curaçao, without regard to its conflict of law principles, save where applicable mandatory consumer protection law of your home jurisdiction requires otherwise.

If you have any questions about these Terms, or wish to report a suspected violation, please contact us at: compliance@netgamenv.com
